Analysis of Major Civil Cases in 2019 - about General Provisions of the Civil Code and the Property Law

초록 : 이 글은 2019년 한 해 동안 대법원이 다룬 민사(민법총칙 및 물권법)에 관한 판결 중 필자가 임의로 선정한 주요 판결 8개를 대상으로 하여, 그 판결을 소개하고 의미를 분석해 본 것이다. 소멸시효, 물권적 청구권, 명의신탁, 취득시효의 중단사유, 구분소유권자의 보존행위, 가등기담보 등에 관하여 이를 소개하면서 간단한 평석 내지 해설을 함으로써 그 판결의 의미를 살펴보았다.

Abstract : This article is an analytic review on major 8 rulings from judgments on civil cases(General Provisions of the Civil Code and the Property Law) handled by the Supreme Court during 2019, which the writer randomly selected. The writer analyzed and criticized some important cases on various subjects including Provisional Registration Security, Partitioned Ownership, Registered Trust, Claim for Removal of Disturbance, Extinctive Prescription, Ownership, Acquisitive Prescription.
