초록 : 2017년 헌법 중요 판례로 주요 헌법재판소 결정들을 선정하여 검토하였다. 2017. 3. 10. 헌법재판소는 역사적인 탄핵심판사건에서 대통령 박근혜에 대한 탄핵심판청구를 전원일치로 인용하여 그를 대통령직에서 파면하였다. 선행결정과 비교해볼 때 탄핵사유에 대한 이유 설시에 약간의 변화가 보인다. 선정된 나머지 사건들에서는 기본권에 관한 쟁점으로서, 변호인의 조력을 받을 권리와 변호인의 형사절차상의 권리, 그리고 개정된 노역장유치조항의 소급적용, 청원경찰의 근로3권 전면제한, 파견금지조항이 위헌인지 여부가 쟁점으로 다루어졌다.

Abstract : This article introduces and reviews major decisions concerning constitutional law rendered by the Constitutional Court of Korea in 2017. In a historic case, Impeachment of the President(Park Geun-hye), the Constitutional Court upheld the impeachment in a unanimous 8?0 decision on 10 March 2017, removing her from office. Compared with the previous impeachment case, the reasoning shows minor changes regarding the requirements for impeachment. The Court dealt with basic right issues in other cases, such as right to counsel and counsel’s right in criminal procedure, the unconstitutionality of the retroactive application of revised ‘Lockup at Workhouse’ clause, the full restriction of the three basic labor rights of ‘Registered Security Guards’, the restriction of ‘Temporary Placement of Workers’.
