Analysis of Major Constitutional Law Cases in 2019

초록 : 헌법 중요판례로 2019년에 선고된 주요 헌법재판소 결정들을 소개한다. 2015. 12. 28. 대한민국 외교부장관과 일본국 외무대신이 공동으로 발표한 ‘일본군 위안부 피해자 문제 관련 합의 내용’을 대상으로 한 헌법소원사건, 낙태죄 사건, 변호인이 되려는 변호사의 접견교통권을 다룬 사건, 자율형 사립고등학교를 후기학교로 지정한 것을 다룬 헌법소원사건, 공직선거법에서 확성장치에 대한 소음규제를 두지 않은 것을 다룬 헌법소원사건 등을 검토대상으로 선정하였다. 필요한 경우 선행결정이나 관련사건도 함께 살펴보았다.

Abstract : This paper looks into major decisions concerning constitutional law rendered by the Constitutional Court of Korea in 2019. Case on the Agreement on comfort women victims jointly announced by the Ministries of Foreign Affairs of both the Republic of Korea and Japan on December 28, 2015, Case on the crime of abortion, Case on the Right to visitation and communication of a lawyer who desires to become a defense counsel, Case on designating Autonomous Private High Schools as schools of the second term, and Case on absence of noise regulation on loudspeaker use during public official election campaign, etc. are included in the selected cases. Where necessary, prior decisions or related cases are also covered.
