Analysis of Family Law Cases of Korean Supreme Court in the year 2019

초록 : 이 글에서는 2019년에 선고된 대법원 재판례 중, 주목할 만한 가족법 쟁점을 다루고 있는 몇몇 판결과 결정들을 검토해 보았다. 주요 쟁점으로는 공무원연금법·국민연금법 등이 인정하는 분할연금제도 - 법적 성격, 이혼에 따른 재산분할 제도와의 관계, 분할비율 별도 결정, 시행 시기(始期)와 적용대상에 관한 부칙의 해석 등 - 와 재산분할의 대상과 가액을 판단하는 기준시점, 친생자 추정에 관한 민법 제 844조 제1항이 적용되는 경우와 그 예외, 친자관계를 다투는 방법, 기여분의 인정요건으로서의 특별한 부양행위의 의미, 배우자의 기여분을 인정할 때 고려할 점 등이 포함되어 있다.

Abstract : Among those decisions rendered by the Supreme Court of Korea in 2019, this paper reviews some decisions addressing noteworthy family law issues.

It includes : pension split system recognized by the Pension Act and the National Pension Act, etc (general rules, reliance on the claim for division of property, otherwise-determined ratio of division, interpretation of the provisions regarding the timing of enforcement), the reference point for determining the object and value for Property Division. Presumption of Paternity, biological blood relationship, social father-son relationship, the contributory portion of the spouse, special support through sharing living accommodations or providing nursing.
