A Review on Court Decisions regarding Family Law in 2017

초록 : 가족법과 관련된 대법원의 판결과 가정법원 판결 중 중요한 것을 골라 검토한다. 가사소송법상 이행명령의 의미 및 이행명령에 기간을 정하여야 하는지 여부, 혼인관계 소송의 관할, 민법 제826조 동거 부양, 협조 의무에 관한 규정과 민법 제833조 공동생활비용 부담에 관한 규정은 별개의 청구원인인지 여부, 재산분할청구권을 미리 양도하는 것이 허용되는지 여부, 연금수급권 발생 전의 연금에 대한 재산분할, 민법 제959조의20 제1항이 본인에 대해 한정후견개시심판 청구가 제기된 후 심판이 확정되기 전에 후견계약이 등기된 경우에도 적용되는지 여부, 성년의 자녀가 부모를 상대로 부양료를 청구할 수 있는 경우 및 범위, 상속포기의 효력이 피상속인을 피대습자로 하여 개시된 대습상속에 미치는지 여부, 상속재산분할과 기여분에 대한 것 등이다.

Abstract : This paper reviews some of the noteworthy decisions concerning Family Law of the Supreme Court and the Family Court in 2017. It includes: order for implementation and implementation period, the exclusive jurisdiction of family court wherein the last common domicile, the cohabitation, support, cooperation or bearing of living expenses by husband and wife pursuant to Articles 826 and 833 of the Civil Act, prohibition of predisposition of the property division right, marital property division about the pension, relationships between guardianship contract and adult guardianship, duty to furnish support and ability of living, effect of renunciation of inheritance on inheritance by representation, decision on the division of inherited property and the contributory portion.
